BACKGROUND TO THE DEVELOPMENT
OF PROVISIONAL PATENTS
Many inventors have the
mistaken belief that in securing priority
rights for a 12-month Provisional Patent,
the applicant must make available accurate
diagrams and even a prototype of the concept
in certain cases. This is not so. A Provisional
Patent application is designed to secure
Provisional Patent priority rights for
even a completely undeveloped, but feasible
idea for 12 months from the date of registration
of the Provisional Patent, in order to
give the originator of the invention or
idea,the security for developing his or
her Provisional Patent concept, possibly
in consultation with others, without jeopardizing
his or her priority rights.
In the registration of a Provisional
Patent,12 months priority rights are also securable
in more than a hundred countries recognized
by South Africa as convention countries. In
proceeding to the registration of a final patent
of a viable Provisional Patent, the original
date of registration of the Provisional Patent,
is carried forward as the effective date of
